James White is a partner in the Washington D.C. firm of Marshall & White, PC, with more than eighteen years’ experience in the areas of government contract law, corporate law, compliance, and international law.  Mr. White regularly advises some of the largest companies in the technology and defense industries, including industry-leading chipset manufacturers, storage OEMs, systems integrators, cloud service providers, and engineering firms.  He also lectures frequently on key subjects in government contracting and intellectual property law, including bid protest trends and strategies; cyber and data security issues; open source licensing and SW sales models; organizational conflicts of interest (OCIs); cross-border and multi-national legal issues; and small business contracting strategies.

 

Mr. White’s government contracts practice includes all phases of the contracting process, including source selection, contract negotiation, compliance, bid protests, claims and REAs, and dispute resolution.  He advises clients on software and data protection issues, cost and pricing issues, Trade Agreements Act and Buy American Act compliance, security clearances and FOCI issues, suspensions and debarments, audits and investigations, and the establishment of robust ethics programs.  Mr. White also assists clients with export and trade control matters, including ITAR and EAR.

 

Mr. White has expertise drafting and negotiating complex agreements such as prime contracts and subcontracts, global FSI and partner agreements, technology transfer agreements, SW licenses and subscription agreements (including SLAs), and software development, co-design and cost-share arrangements.  Mr. White has litigated contract disputes in both federal and state court, as well as in specialized forums including the Court of Federal Claims (COFC), and the Boards of Contract Appeals (BCAs).  He has also represented both protestors and intervenors in protests filed with the General Accountability Office (GAO), and with several state and local forums.  Mr. White has assisted clients with matters involving nearly every federal agency, including DoD (including all military branches), DHS, DoE and its research laboratories, GSA, NASA, and most of the Government’s intelligence agencies.  Overall, his practice includes a diverse range of clients, both established and emerging, across various high-tech, manufacturing, and security industries.

 

Prior to co-founding Marshall & White, Mr. White was an attorney in the Washington D.C. office of Winston & Strawn, LLP, representing industry-leading government contractors and technology providers in complex litigation, transactional and compliance matters.  Prior to entering private practice, Mr. White served on active duty as a member of the United States Air Force’s Judge Advocate General (JAG) Corps.  During his tour, Mr. White served as lead counsel to several multi-billion dollar systems programs, as well as a senior trial attorney in the Air Force’s Office of Dispute Resolution.  In 2006, Mr. White was selected as one of only three senior contract attorneys to advise the Joint Contracting Command Multi-National Forces Iraq on the Coalition’s $30 billion reconstruction effort.
